A temporary restraining order prevents spouses from specific actions during divorce proceedings. Temporary restraining orders, also called TROs, are issued by the court system to protect a couple's assets and minor children while divorce actions are pending. These restraining orders are temporary in nature because they do not affect the settlement agreement in the case. Once the divorce is finalized, the restraining order is rescinded.

Getting a Temporary Restraining Order in Texas

To be granted a temporary restraining order, either party in a family law case can file a motion for a temporary order, temporary restraining order, or temporary injunction. Applying for a TRO doesn’t require advance notice to the affected party or the other party to be present in court. While the court will schedule a temporary orders hearing, your attorney can handle the entire process on your behalf. 

For the order to proceed, you will need to submit an affidavit if your order: 

  • Involves a minor child
  • Change the physical custody of a child
  • Prevent a party from gaining access to a minor child

Once the judge signs a TO, it lasts 14 days unless the court stipulates otherwise. The court can at anytime choose to dissolve or extend a TRO. A change of notice order must be included in the TRO, and the hearing will take place during the effective period of the current TRO. The court has several options when applying, modifying or terminating temporary orders, and each restrictive order differs. 

Temporary Orders, Temporary Restraining Orders, and Temporary Injunctions

Temporary Orders: A temporary orders is placed in a case until a final judgment is rendered. Final orders can take anywhere from a couple of weeks to several months.

Temporary Injunctions: Temporary restraining orders and temporary injunctions are very similar. They both tell one person actions they are not allowed to do or places they are not allowed to be. 

Temporary Restraining Order (TRO): A TRO is a court document limiting the actions of a party in reference to their interactions with a child or their assets in a divorce. A TRO can be granted without notification and is only good for 14 days. 

 

For any type of restraining instrument to be effective, the respondent must receive a notification. The affected party cannot adhere to an order they have not been instructed to obey.

TROs prevent spouses from many courses of action, including: 

  • Using joint funds
  • Selling property
  • Assuming any additional debt
  • Harassment 
  • Changing schools or daycare facilities 
  • Changing life insurance beneficiaries
  • Opening personal mail of their spouse
  • Deny access to or hiding assets or property
  • Intentional property damage to harm the assets or financial interests of their spouse
  • Accessing lockboxes or safes owned by the other party or representing a joint asset
  • Deny access to a minor child until a custody hearing is held

TROs are not universal documents, so while they are directed toward the actions of a targeted individual, they should not be given to third parties with the expectation they will enforce them.
