What Is an Uncontested Divorce?

An uncontested divorce (sometimes referred to as an agreed divorce) is a divorce in which the divorcing parties agree on the terms of their divorce settlement and do not need their case litigated in divorce court. In Texas, uncontested divorce is considered a simplified divorce process.

Some of the requirements to file for uncontested divorce include:

  • The couple must have lived in Texas for a minimum of six months
  • The couple must have lived in the county of filing for a minimum of 90 days
  • The couple doesn’t have minor children
  • Both parties agree on all divorce terms
  • Both parties agree to file for a no-fault divorce

If you and your spouse share children, you will not qualify for an uncontested divorce in Texas. Additionally, if you disagree, even on just one issue, you will have to file for a contested divorce.
